Terms of Service

These Terms of Service ("Agreement") constitute a legally binding contract between you ("User", "Investor") and Brainchild Investments ("Company", "We", "Us"). By creating an account, accessing our dashboard, or utilizing our management services, you acknowledge that you have read, understood, and agreed to be bound by every provision of this Agreement.

We reserve the right to modify, amend, or restate these Terms at any time. Significant changes will be communicated via email or dashboard notification. Continued use of the platform after such modifications constitutes your express consent to the updated Terms.

By using our services, you specifically acknowledge the following risks:

• Market Volatility: Financial markets can move rapidly and unpredictably. Liquidations, flash crashes, and extreme volatility are common and can result in total loss of funds.
• No Financial Advice: Any information, charts, or analysis provided on the dashboard are for informational purposes. Brainchild Investments is not a registered fiduciary advisor; you are responsible for your own financial decisions.
• Asset Selection: We manage diversified portfolios across BTC, ETH, and other high-liquidity assets. However, individual asset failure or regulatory crackdowns on specific tokens could negatively impact your balance.
• Platform Risk: While we use enterprise-grade security, no digital system is 100% immune to bugs, latency issues, or connectivity failures.

To maintain the integrity of our platform and comply with international Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations, all users must undergo identity verification.

You represent and warrant that: (a) you are of legal age; (b) you have not been previously suspended from our services; (c) you are not located in a restricted jurisdiction (including but not limited to North Korea, Iran, or sanctioned regions).

We reserve the right to freeze accounts or restrict withdrawals if fraudulent activity is suspected or if provided identification documents are found to be invalid or expired.

Brainchild Investments provides managed investment accounts where capital is deployed into algorithmic and manual trading strategies.

• Management Fees: A standard management fee may be applied to your active balance depending on your selected tier.
• Performance Fees: We operate on a success-based model. A percentage of net profits generated may be retained as a performance fee.
• Withdrawals: Withdrawal requests are processed within 1-3 business days. Note that withdrawing during active trade cycles may be restricted to protect the portfolio's margin.

Security is a shared responsibility. While we employ 256-bit encryption and cold storage for assets, you are responsible for securing your access credentials.

We strongly recommend enabling Two-Factor Authentication (2FA). Brainchild Investments will never ask for your password or OTP via email or phone. We are not liable for losses resulting from phishing attacks, credential stuffing, or authorized access to your personal devices.

Users are strictly prohibited from:

• Engaging in any automated scraping or data mining of our market feeds.
• Attempting to bypass security protocols or reverse-engineer our proprietary trading algorithms.
• Using the platform to facilitate money laundering, terrorist financing, or other illegal financial activities.
• Spreading false information about the platform to manipulate market sentiment.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINCHILD INVESTMENTS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES.

Our total liability to you for any claims arising out of this Agreement shall not exceed the total management fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim.

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration. You waive your right to participate in any class-action lawsuit or class-wide arbitration against Brainchild Investments.
